A BILL to amend article two, chapter seventeen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section seven-d, relating to requiring drivers to be retested periodically.

Be it enacted by the Legislature of West Virginia:
That article two, chapter seventeen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section seven-d, to read as follows:
ARTICLE 2. ISSUANCE OF LICENSE, EXPIRATION AND RENEWAL.

§17B-2-7d. Reexamination of licensees.
After an individual has held a valid driver's license in this state for a period of ten years the licensee shall be reexamined to determine his or her fitness to drive a motor vehicle. The division of motor vehicles, therefore, shall examine every such licensee for the reissuance of a license to operate a motor vehicle in this state. The reexamination shall include a test of the applicant's eyesight, the applicant's ability to read and understand highway signs regulating, warning, and directing traffic, the applicant's knowledge of the traffic laws of this state, and the applicant's knowledge of the effects of alcohol upon persons and the dangers of driving a motor vehicle under the influence of alcohol. The reexamination shall also include an actual demonstration of ability to exercise ordinary and reasonable control in the operation of a motor vehicle, and any further physical and mental reexamination as the division of motor vehicles considers necessary to determine the applicant's fitness to operate a motor vehicle safely upon the highways. The reexamination shall be in accordance with the rules previously required to be proposed under subdivision (b), section seven of this article.



NOTE: The purpose of this bill is to require the reexamination of drivers licensees who have held a valid driver's license for ten years.
